How to Make Your Chapter 13 Bankruptcy Successful

  It is a sad fact that the vast majority of Chapter 13 Bankruptcies are not successful. Here are some tips to make your Chapter 13 Bankruptcy a success.

  •  Hire an attorney before you file your bankruptcy. It is almost impossible to succeed in a Chapter 13 Bankruptcy without an attorney. The sad fact is that less an 1% of Chapter 13 Bankruptcies where the debtors do not have an attorney were successful in having their plan approved by the Bankruptcy Court. You cannot afford to do this alone.
  • Be proactive and keep your attorney in the loop. Chapter 13 Bankruptcies last 3 to 5 years. During that time, life happens which can include unexpected expenses, job loss, pay reductions, marriage, divorce, death, birth, and all the other fun things life brings us. When you experience changes, talk to your attorney before your case has problems and see if your attorney can help you.
  • Monitor your Bankruptcy Plan Payments. Here in Waco, Texas, our Chapter 13 Trustee has a website where clients can login and monitor their cases. They can quickly tell if the Trustee is receiving their bankruptcy payments. Furthermore, they can monitor if the payments increase during the bankruptcy. Your bankruptcy Trustee may dismiss your bankruptcy if you fall behind on your payments. Therefore, I encourage all of my clients to check the trustee's website at least once a month to ensure their bankruptcy is current and to monitor any increases in payments.
  • Keep Records. Keep a copy of your trustee payments, mortgage payments, and car payments (if you are making those outside of your plan) so if there is any problem, you can quickly pull those records out and have them ready for your attorney. Do not make checks by phone or send money orders to ensure nice clean records.
  • Budget and Communicate with Your Family. You need to work as a family to make a budget and stick to it to succeed. Filing a Chapter 13 Bankruptcy is not a quick fix. You will need to make adjustments in your life to make it work. Budgeting will help you make those adjustments.
