What documentation does the court require for Chapter 13?

Perhaps you have been considering filing a Chapter 13 bankruptcy as a solution to your present financial setbacks. Many Texans take advantage of Chapter 13 benefits every year and still others would likely reap benefits if they too decided to take the step. But sometimes people delay or even avoid filing because they fear the process itself would be too arduous.

And while collecting and presenting the required documentation to the court does take some work, it is much easier to approach the task if you understand what is needed for a successful filing. The following are some of the items that you must file with the court:

  • A credit counseling certificate.
  • A copy of your debt repayment plan, if you made one during credit counseling.
  • A schedule of your current expenditures and income.
  • Schedules of your liabilities and assets.
  • A statement regarding your financial affairs.
  • A schedule of your unexpired leases and executory contracts.

There are some other documents regarding such things as your income, educational loan debts and tax records that the court will also want to look at. So, as you can see, there is a fair amount of paperwork that you will need to gather. But if you have kept reasonable track of your records the process should not prove too daunting if you take things a step at a time.

Another way to simplify the filing process is to solicit the services of an experienced bankruptcy attorney. An attorney who is familiar with the details of Chapter 13 process can help you take the necessary steps to efficiently get the fresh financial start you are looking for.
