Signs You May be Heading Towards Bankruptcy

People have debt problems for many reasons including job loss, medical bills, divorce, and retirement. But what are some signs that you debt is starting to overwhelm you and you might need to consult with a bankruptcy attorney?

  • Your credit card balances are increasing. As I have discussed before, my bankruptcy clients tend to fall into a predictable and understandable pattern. They have a decrease in income due to job loss, divorce, retirement, or another reason. They start using credit cards hoping that next month it will get better. It doesn't get better and the credit card balances continue to increase and increase every month until the limits are reduced or maxed out.
  • You are borrowing money for consumption purpose. There is a stereotype that a person who files for bankruptcy protection is running up debt for luxury items like expensive vacations and big screen TVs. But most of my bankruptcy clients are struggling to pay for food on the table. If they didn't have the large credit card bills and payday loan payments, they could budget money for necessities like rent, food, electricity, and gasoline. But they can't, so they fall further and further into a debt trap.
  • You have reached the threshold limit of borrowing. The credit cards are maxed and you are taking out payday loans to pay payday loans. As stated above, my typical clients are skating on credit until the credit runs out. With approximately 70% of Americans living paycheck to paycheck, it is easy to see how a decrease in income can lead to bankruptcy.
